VIRGINIA MEDICAID INCOME RULES
Virginia is NOT an "Income Cap" State.
The Minimum Monthly Maintenance Income Allowance (MMMIA)
The Minimum Monthly Maintenance Income Allowance (MMMIA) is the amount of income the "Community Spouse" (the "well-spouse") is entitled to receive. For Year 2009, this minimum amount is set at $ 1821.25 per month. The maximum is $2739.00 per month.
The MMMIA consists of the well-spouse's gross monthly income, plus an amount diverted from the nursing home spouse's income in order to meet this minimum amount.
The MMMIA can be increased through one of two mechanisms; either the Fair Hearing Process, or through a Court-Order. The final allowance is determined through a complex calculation per Medicaid guidelines and rules.
